THE QUICK DEMAND STAGE OF SECURITY DEPOSIT CASES WITH DEBI RUMPH’S TENANTS CLINIC

The Quick Demand Stage (“Stage”) is the first recommended stage after the Boarding Process Stage.  Once we have some necessary information from you, we hope to have enough information to send your landlord a demand letter that provides your landlord with a very quick opportunity to settle this matter (“Quick Demand Letter”).  However, before we start this Stage, we will send you a retainer agreement.

The Quick Demand Letter provides the landlord with a quick opportunity to return the security deposit.   Additionally, The Quick Demand Letter will demand that the landlord pay us attorney's fees directly.  However, what happens if the landlord refuses to pay our attorney's fees directly but pays the demand's full amount?  It depends on the language in the lease.

In most cases, the attorney's fees provision in the lease will be unfavorable.  Therefore, we will have no choice but to share in your recovery as our payment in these cases.   If your case falls in this particular category, after we collect your security deposit, deduct our fees, and return the remainder of your security deposit to you, we will close your case.

However, if your lease allows us to recover attorney's fees from your landlord without going to court, it is possible to stand firm and proceed to the next step.  If your case falls into this particular category, we will inform you of such and will allow you to decide how to proceed further.

If all goes well during this Stage, you will have received a return of the security deposit very quickly and at a minimal cost (no out of pocket $).  This Stage also has minimal risk. The landlord is not likely to seek attorney's fees against you during this Stage (although landlords commonly assert such threats as a negotiation strategy).

However, if we do not succeed during this stage, we decide whether you would like to move to the next stage:  The Motivational Demand Stage.
