THE MOTIVATIONAL DEMAND STAGE OF SECURITY DEPOSIT CASES WITH DEBI RUMPH’S TENANTS CLINIC

If the Quick Demand Stage does not get your matter quickly settled, then we have the option of proceeding to The Motivational Demand Stage (“Stage”).  In this Stage, we will send the landlord another demand letter–giving the landlord strong motivation to settle.  For example, it is very common for us to find other causes of action to assert against the landlord, increasing the landlord's potential liability.

During this Stage, we also continue to evaluate your documents and interview answers.  In anticipation of a potential upcoming court battle with your landlord, we then strategize to collect information and documents directly from the landlord to support your case against the landlord even further.

We will demand increased damages during this Stage and, again, demand that the landlord pays our attorney's fees directly.  However, again, depending on your lease's language, we may share in your recovery if the landlord reasonably refuses to pay our fees directly.

If all goes well during this Stage, you will have received a security deposit return in a few months but still, at a minimal cost (no out of pocket $).  This Stage also has minimal risk. The landlord is not likely to seek attorney's fees against a tenant during this stage (although landlords commonly assert such threats as a negotiation strategy).

However, if we do not succeed under The Motivational Demand Stage, then we have the option of determining whether you're ready to move to the next stage: The Lawsuit Stage.
